This Privacy Statement explains how OSMOND may use, process and store your personal data.

 

PERSONNAL DATA COLLECTED BY OSMOND

Personal Data covers all information relating to an individual

OSMOND collects personal data directly from clients, prospective clients, partners, beneficial owners, service providers, contracting parties, candidates and intermediaries within the framework of its activities.
OSMOND also collects and processes personal data from publicly accessible sources such as internet, social networks or commercial registers. Furthermore OSMOND may receive personal data from third parties as part of the services OSMOND provides to you or in connection with legal requirements that are applicable to OSMOND

OSMOND may collect, use, store and transfer the following categories of personal data:

Identity Data: such as name, surname, marital status, date of birth, ID or passport number, photo, gender, social media account, …

Contact Data: such as email address, telephone number, billing address, delivery address, …
Financial Data: such as bank account number, details about payments to and from you, …• Technical Data: information collected when you visit our website, IP address, browser type and version, time zone setting and location, information about your use of our website, your use of our wifi, …

Professional Data: such as your Curriculum Vitae, you job title and your previous positions and professional experience, preferred language …

• In very limited circumstances OSMOND may collect sensitive data about you such as: your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data.

USE YOUR PERSONAL INFORMATION

Your information is collected for the following purposes:

– to provide legal services;
– to identify and contact clients, prospects, partners or service providers;
– to check for conflict of interests;
– to comply with legal obligations in the fight against money laundering and the financing of terrorism, and identify the source of any financing or funds in one of its files;
– to ensure the administrative management of business (for example, invoicing, accounting and recovery of sums due);
– to manage and optimize the website;
– to send topical information, newsletters and invitations to its events;
– to process applications in relation with employment offers;
– to interact with the courts, regulatory and supervisory authorities;
– to ensure the recognition, exercise and defence of rights in court;
– for any other purpose required by law.

The processing of data can only be done for a specific purpose.
If your Personal Data is necessary for purposes other than those initially determined, it may only be used if this new purpose is compatible with the original purpose.

 

CONSEQUENCES IF YOU DO NOT PROVIDE THE PERSONAL DATA REQUESTED

When OSMOND needs to collect Personal Data to conclude or execute a contract with you and you refuse to provide the requested data, OSMOND may refuse to provide or receive the services concerned.
In this event, OSMOND will inform you of this at the time the Personal Data is requested.

 

RECIPIENTS OF YOUR PERSONAL DATA

As your Personal Data is confidential, OSMOND may only communicate it to the following recipients:

• Third parties engaged in the course of the services we provide to clients (e.g. notaries).
• Third parties to whom we outsource certain services such (e.g. IT, postal services);
• Government or regulatory authorities.
• Regulators/tax authorities/corporate registries.
• Our professional advisers such as lawyers and accountants.

 

CROSS BORDER OF PERSONAL DATA

The recipients of personal data may be in countries other than the Grand Duchy of Luxembourg. However, your Personal Data will normally only be transferred within European Union or countries providing an adequate level of personal data protection.
In the event of recourse to service providers located outside the European Union, OSMOND undertakes to check that appropriate procedures have been set in order to provide for the same level of protection as provided by the GDPR.

 

STORAGE OF PERSONAL DATA

Your Personal Data is stored by OSMOND at its registered office.
Personal Data contained in the e-mails that we exchange are stored in France by our service provider, OVH S.A.S.

 

DATA PROTECTION

OSMOND has taken appropriate measures to protect your personal data against loss or any form of unlawful processing.

 

RETENTION PERIOD

OSMOND will process and store the relevant personal data for the duration of its legal services or for the duration of the business relationship. OSMOND may also store the data for as long as it is necessary or required in order to fulfil legal, contractual or statutory obligations, or for the establishment, exercise or defense of legal claims, and in general where it has a legitimate interest to do so.

Each person subject to data collection by OSMOND benefits under the applicable data protection legislation from a right to access, of modification, limitation and opposition to the processing of his/her personal data, a right to erasure and a right to portability of his/her personal data by contacting the DPO at the contact information given above. Those rights may only be exercised within the limits of the relevant texts, in particular of any contractual or legal obligation. Each Data Subject has also a right to lodge a complaint with the Luxembourg supervisory authority, the National Data Protection Commission (Commission nationale pour la protection des données)

In accordance with Regulation (EU) 2016/679 of the Parliament and of the Council of April 27, 2016, you have the right to modify the personal data collected about you.

 

CHANGES TO THIS PRIVACY STATEMENT

OSMOND reserves the right and is entitled to change this Privacy notice at any time and for any reason whatsoever.
